The European Parliament Committee on Economic and Monetary Affairs (ECON committee) just reached a preliminary deal for this crypto regulation in Europe. But that\u2019s not all: beyond MiCA, lawmakers are aiming<strong> to apply the travel rule for users and service providers and overseeing Decentralized Finance (DeFi)<\/strong> protocols as well.<\/p>\n\n\n\n<p>In summary, the <a href=\"https:\/\/alfacash.blog\/ar\/2022\/08\/14\/mica-law-crypto-more-europe-what-you-need-know\/\" target=\"_blank\" rel=\"noreferrer noopener\">MiCA law<\/a> will especially affect the use of stablecoins, token issuers, and cryptocurrency companies. All of them will need to comply with some basic rules if they want to operate inside the European Union or for EU citizens. To get an official license, crypto services will be subject to Anti-Money Laundering\/Combating the Financing of Terrorism (AML\/CFT) rules, while providing reports of their activities and a minimum capital.<\/p>\n\n\n\n<p><a href=\"https:\/\/alfacash.blog\/ar\/2020\/12\/06\/%d8%b9%d9%85%d9%84%d8%a7%d8%aa-%d9%85%d8%b3%d8%aa%d9%82%d8%b1%d8%a9-%d9%88%d8%a3%d9%86%d9%88%d8%a7%d8%b9-%d8%af%d8%b1%d8%b3-%d8%b3%d9%87%d9%84-%d9%88%d9%85%d8%ae%d8%aa%d8%b5%d8%b1\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u0639\u0645\u0644\u0627\u062a \u0645\u0633\u062a\u0642\u0631\u0629<\/a> will have limitations of use, and the algorithmic type (<a href=\"https:\/\/alfacash.blog\/ar\/2022\/05\/14\/terra-ust-collapse-what-means-crypto-market-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">like Terra<\/a>) won\u2019t be welcome. All of them must own backup reserves in fiat currency. The European Securities and Markets Authority <strong>(ESMA) will be responsible for the supervision of crypto assets<\/strong>. They\u2019ll provide guidelines and delimitate the coins under control, which may include some Non-Fungible Tokens (<a href=\"https:\/\/alfacash.blog\/ar\/2021\/04\/11\/%d9%85%d8%a7-%d9%87%d9%8a-%d8%a7%d9%84%d8%b1%d9%85%d9%88%d8%b2-%d8%ba%d9%8a%d8%b1-%d8%a7%d9%84%d9%82%d8%a7%d8%a8%d9%84%d8%a9-%d9%84%d9%84%d9%81%d8%b7%d8%b1%d9%8a%d8%a7%d8%aa-nfts-%d9%84%d9%85%d8%a7\/\" target=\"_blank\" rel=\"noreferrer noopener\">NFTs<\/a>).<\/p>\n\n\n\n<figure class=\"wp-block-embed aligncenter is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">MEPs from <a href=\"https:\/\/twitter.com\/EP_Economics?ref_src=twsrc%5Etfw\">@EP_Economics<\/a> voted to confirm w\/ 28\/1 provisional deal on markets in crypto assets <a href=\"https:\/\/twitter.com\/hashtag\/MICA?src=hash&amp;ref_src=twsrc%5Etfw\">#MICA<\/a> <a href=\"https:\/\/twitter.com\/DrStefanBerger?ref_src=twsrc%5Etfw\">@DrStefanBerger<\/a> ahead of the final plenary vote<br>30 June deal details \u2b07\ufe0f\u2b07\ufe0f\ud83d\uddd2\ufe0f<a href=\"https:\/\/t.co\/zFPKaTxki9\">https:\/\/t.co\/zFPKaTxki9<\/a><\/p>&mdash; ECON Committee Press (@EP_Economics) <a href=\"https:\/\/twitter.com\/EP_Economics\/status\/1579501816508604416?ref_src=twsrc%5Etfw\">October 10, 2022<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>In the same vein, EU lawmakers also <a href=\"https:\/\/blockworks.co\/european-crypto-regulations-enter-final-phase\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">\u0648\u0635\u0644<\/a> another provisional agreement for the Transfer of Funds Regulation (TFR). This law, equivalent to the <a href=\"https:\/\/alfacash.blog\/ar\/2021\/07\/20\/%d9%85%d8%ad%d8%a7%d9%81%d8%b8-%d8%b9%d9%85%d9%88%d9%84%d8%a9-%d8%a3%d9%88%d8%b1%d9%88%d8%a8%d9%8a%d8%a9-%d8%aa%d8%b3%d8%b9%d9%89-%d9%84%d9%84%d8%ad%d8%b8%d8%b1-%d8%a7%d9%84%d9%85%d8%ac%d9%87%d9%88\/\" target=\"_blank\" rel=\"noreferrer noopener\">travel rule<\/a>, was designed to trace and block suspicious transactions \u2014for example, operations aimed at money laundering or avoiding sanctions.<\/p>\n\n\n\n<p>Sadly for some crypto users, TFR <a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20220627IPR33919\/crypto-assets-deal-on-new-rules-to-stop-illicit-flows-in-the-eu\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">implies<\/a> \u0630\u0644\u0643 <strong>any crypto transaction of over 1,000 EUR involving a cryptocurrency exchange will be registered and controlled<\/strong>. The user, even sending from or receiving to a <a href=\"https:\/\/alfacash.blog\/ar\/2021\/09\/15\/%d8%b9%d8%a7%d9%85-%d8%ae%d8%a7%d8%b5-%d9%85%d9%81%d8%a7%d8%aa%d9%8a%d8%ad-%d9%84%d9%85%d8%a7%d8%b0%d8%a7-%d9%85%d9%87%d9%85-%d8%a7%d8%ad%d8%aa%d9%81%d8%b8-%d8%b9%d9%85%d9%84%d8%a7%d8%aa-%d8%b9%d9%85\/\" target=\"_blank\" rel=\"noreferrer noopener\">non-custodial wallet<\/a>, will need to identify and prove the ownership of the address. Beyond this, P2P transactions aren\u2019t included.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Crypto regulation for DeFi in Europe<\/strong><\/h2>\n\n\n\n<p>The MiCA law only needs to get approval from the European Council before coming into force \u2014in 2024. This set of rules doesn\u2019t include <a href=\"https:\/\/alfacash.blog\/ar\/2020\/09\/09\/%d9%83%d9%8a%d9%81-%d8%aa%d8%b5%d9%86%d8%b9-%d8%a2%d9%84%d8%a7%d9%81-%d8%a7%d9%84%d8%af%d9%88%d9%84%d8%a7%d8%b1%d8%a7%d8%aa\/\" target=\"_blank\" rel=\"noreferrer noopener\">DeFi protocols<\/a>, which, in theory, shouldn\u2019t have the same laws as centralized services. As it reads:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThe project will seek to benefit from the open nature of transaction data on the Ethereum blockchain, which is the biggest settlement platform of DeFi protocols. Its main focus will be on automated supervisory data gathering directly from the blockchain to test the technological capabilities for supervisory monitoring of real-time DeFi activity.\u201d<\/p><\/blockquote>\n\n\n\n<p>For now, this seems to be barely a project, but it could become law in the future.
