Die Vorschriften f\u00fcr die Verwendung von Kryptow\u00e4hrungen werden in den Niederlanden immer strenger. Vor kurzem hat die niederl\u00e4ndische Zentralbank (DNB) den nationalen Kryptow\u00e4hrungsunternehmen neue gesetzliche Verpflichtungen auferlegt, die \u00fcber den \u00fcblichen KYC-Prozess (Know Your Customer) hinausgehen.<\/p>\n\n\n\n

Anscheinend reicht es jetzt nicht mehr aus, Dokumente zur Identifizierung bereitzustellen und \/ oder in einigen F\u00e4llen ein altes und verifiziertes Konto zu besitzen Kryptow\u00e4hrungsaustausch<\/a>. Das an der Transaktion beteiligte Unternehmen sollte pr\u00fcfen, ob \u201eseine Kunden und alle letztendlichen Beg\u00fcnstigten (UBOs) auf einer niederl\u00e4ndischen oder europ\u00e4ischen Sanktionsliste stehen\u201c.<\/strong> und melden Sie es sofort der zentralen Einrichtung.<\/p>\n\n\n\n

F\u00fcr die Benutzer diese Regelung<\/a> impliziert zus\u00e4tzliche \u00dcberpr\u00fcfungen wie eine Erkl\u00e4rung des Zwecks f\u00fcr ihre Transaktion, die Art der Brieftasche und Screenshots oder das Signieren von Nachrichten. Falls der Kunde auf der Sanktionsliste steht, sollten die Transaktion und das Konto von der B\u00f6rse eingefroren werden.<\/p>\n\n\n\n

Gem\u00e4\u00df die Ank\u00fcndigung<\/a>:<\/p>\n\n\n\n

\u201eIm Falle eines tats\u00e4chlichen Treffers in einer Sanktionsliste muss das Institut die DNB unverz\u00fcglich benachrichtigen sowie Verm\u00f6genswerte einfrieren, die Transaktion blockieren oder beides tun. Dementsprechend d\u00fcrfen Verm\u00f6genswerte nicht an andere, nicht sanktionierte Parteien weitergegeben werden. In bestimmten F\u00e4llen muss auch die FIU-NL (Financial Intelligent Unit) benachrichtigt werden. \u201c<\/p><\/blockquote>\n\n\n\n

Wenn das Unternehmen den Treffer nicht meldet, wird seine Aktion unter dem bestraft Gesetz \u00fcber wirtschaftliche Straftaten<\/a>. Eine solche Regelung sieht Geldstrafen bis zu 82.000 EUR (f\u00fcnfte Kategorie) und sogar sechs Jahre Gef\u00e4ngnis vor<\/strong>, abh\u00e4ngig von der finanziellen Straftat. Dar\u00fcber hinaus k\u00f6nnen zus\u00e4tzliche Sanktionen die vollst\u00e4ndige Schlie\u00dfung des Unternehmens, die Beschlagnahme der Mittel und der Entzug staatlicher Leistungen sein.<\/p>\n\n\n\n

Gegen die Ma\u00dfnahme<\/strong><\/h2>\n\n\n\n

Die Kryptow\u00e4hrungsunternehmen und -benutzer in den Niederlanden freuen sich nicht \u00fcber die Ank\u00fcndigung. Argumente dagegen<\/a> Dazu geh\u00f6rt, dass nicht einmal die Nationalbanken dazu verpflichtet sind, und die Regulierung war pl\u00f6tzlich und hat keine solide Rechtsgrundlage.<\/p>\n\n\n\n

Der Bitcoin-Unternehmer und Datenschutzbeauftragte Matt Odell<\/a> erkl\u00e4rte, dass dies die \u201enat\u00fcrliche Entwicklung von KYC \/ AML<\/a> regs \u201dund ein \u201eoffensichtlicher Vorl\u00e4ufer f\u00fcr ordnungsgem\u00e4\u00dfe Selbstverwahrungsverbote\u201c weltweit.<\/strong><\/p>\n\n\n\n

Leider sollten die Kryptow\u00e4hrungsfirmen, die legal in dem Gebiet t\u00e4tig sein wollen, vor dem 21. November 2020 bei den Beh\u00f6rden registriert werden. Trotz ihrer Neuheit sind diese zus\u00e4tzlichen Ma\u00dfnahmen \u00fcber KYC hinaus Voraussetzung f\u00fcr die Registrierung. Die Unternehmen sollten sich also anpassen oder schlie\u00dfen.<\/p>\n\n\n\n

Inzwischen einige Akteure der Branche<\/a> erheben ihre Stimme gegen diese spezielle Entscheidung oder versuchen zumindest, mehr Zeit zu gewinnen, um ihre Systeme und Kunden daran anzupassen.<\/p>\n\n\n\n
