Les r\u00e9glementations relatives \u00e0 l'utilisation des crypto-monnaies sont de plus en plus strictes aux Pays-Bas. R\u00e9cemment, sa banque centrale n\u00e9erlandaise (DNB) a impos\u00e9 de nouvelles obligations l\u00e9gales aux soci\u00e9t\u00e9s nationales de crypto-monnaie, qui vont au-del\u00e0 du processus commun Know Your Customer (KYC).<\/p>\n\n\n\n

Apparemment, il ne sera plus suffisant de fournir des documents d'identification et \/ ou de poss\u00e9der un compte ancien et v\u00e9rifi\u00e9 dans certains \u00e9change de crypto-monnaie<\/a>. La soci\u00e9t\u00e9 impliqu\u00e9e dans la transaction doit v\u00e9rifier si \u00abses clients et les \u00e9ventuels propri\u00e9taires b\u00e9n\u00e9ficiaires ultimes (UBO) figurent sur une liste de sanctions n\u00e9erlandaise ou europ\u00e9enne\u00bb<\/strong> et le signaler imm\u00e9diatement \u00e0 l'institution centrale.<\/p>\n\n\n\n

Pour les utilisateurs, ce r\u00e8glement<\/a> implique des contr\u00f4les suppl\u00e9mentaires comme une d\u00e9claration du but de leur transaction, le type de portefeuille et des captures d'\u00e9cran ou la signature de messages. Dans le cas o\u00f9 le client est sur la liste des sanctions, la transaction et le compte doivent \u00eatre gel\u00e9s par l'\u00e9change.<\/p>\n\n\n\n

Selon l'annonce<\/a>:<\/p>\n\n\n\n

\u00abEn cas de succ\u00e8s r\u00e9el dans une liste de sanctions, l'institution doit imm\u00e9diatement en informer DNB, ainsi que geler les actifs, bloquer la transaction ou faire les deux. En cons\u00e9quence, les actifs ne peuvent \u00eatre c\u00e9d\u00e9s \u00e0 aucune autre partie non sanctionn\u00e9e. La FIU-NL (Financial Intelligent Unit) doit \u00e9galement \u00eatre notifi\u00e9e dans des cas sp\u00e9cifiques \u00bb.<\/p><\/blockquote>\n\n\n\n

Si l'entreprise ne signale pas le coup, son action serait punissable en vertu du Loi sur les infractions \u00e9conomiques<\/a>. Un tel r\u00e8glement d\u00e9crit des amendes allant jusqu'\u00e0 82.000 EUR (cinqui\u00e8me cat\u00e9gorie) et m\u00eame six ans de prison<\/strong>, en fonction de l'infraction financi\u00e8re. En outre, des sanctions suppl\u00e9mentaires peuvent \u00eatre la fermeture totale de l'entreprise, la saisie des fonds et le retrait des avantages gouvernementaux.<\/p>\n\n\n\n

Contre la mesure<\/strong><\/h2>\n\n\n\n

Les soci\u00e9t\u00e9s de crypto-monnaie et les utilisateurs aux Pays-Bas ne sont pas tr\u00e8s heureux de l'annonce. Arguments encontre<\/a> inclure que m\u00eame les banques nationales ne sont pas oblig\u00e9es de le faire, et le r\u00e8glement a \u00e9t\u00e9 un peu soudain et il n'a pas de base juridique solide.<\/p>\n\n\n\n

Pendant ce temps, certains acteurs de l'industrie<\/a> \u00e9l\u00e8vent la voix contre cette d\u00e9cision particuli\u00e8re, ou du moins essaient de gagner plus de temps pour y adapter leurs syst\u00e8mes et leurs clients.<\/p>\n\n\n\n
