Forskrifter for bruk av kryptovaluta blir strengere i Nederland. Nylig leverte den nederlandske sentralbanken (DNB) nye juridiske forpliktelser for de nasjonale kryptovalutaselskapene, som g\u00e5r utover den vanlige Know Your Customer (KYC) -prosessen.<\/p>\n\n\n\n

Tilsynelatende vil det n\u00e5 ikke v\u00e6re nok \u00e5 gi dokumenter til identifikasjon og \/ eller eie en gammel og bekreftet konto i noen kryptokursutveksling<\/a>. Selskapet som er involvert i transaksjonen b\u00f8r sjekke om "deres kunder og eventuelle endelige mottakereiere (UBO-er) er p\u00e5 en nederlandsk eller europeisk sanksjonsliste"<\/strong> og umiddelbart rapportere det til sentralinstitusjonen.<\/p>\n\n\n\n

For brukerne, denne forskriften<\/a> inneb\u00e6rer ytterligere sjekker som en erkl\u00e6ring om form\u00e5let med deres transaksjon, type lommebok og skjermbilder eller signeringsmeldinger. I tilfelle kunden er p\u00e5 sanksjonslisten, b\u00f8r transaksjonen og kontoen fryses av sentralen.<\/p>\n\n\n\n

I f\u00f8lge kunngj\u00f8ringen<\/a>:<\/p>\n\n\n\n

\u201cI tilfelle det faktisk treffes en sanksjonsliste, m\u00e5 institusjonen umiddelbart varsle DNB, samt fryse eventuelle eiendeler, blokkere transaksjonen eller gj\u00f8re begge deler. F\u00f8lgelig kan ikke eiendeler frigj\u00f8res til noen annen, ikke-sanksjonert part. FIU-NL (Financial Intelligent Unit) m\u00e5 ogs\u00e5 varsles i spesifikke tilfeller \u201d.<\/p><\/blockquote>\n\n\n\n

Hvis selskapet ikke rapporterer treffet, vil dets handling v\u00e6re straffbart under Lov om \u00f8konomisk lovbrudd<\/a>. En slik regulering beskriver b\u00f8ter p\u00e5 opptil 82.000 EUR (femte kategori) og til og med seks \u00e5rs fengsel<\/strong>, avhengig av \u00f8konomisk lovbrudd. Dessuten kan ytterligere sanksjoner v\u00e6re total nedleggelse av selskapet, beslag av midler og tilbaketrekning av offentlige fordeler.<\/p>\n\n\n\n

Mot tiltaket<\/strong><\/h2>\n\n\n\n

Kryptovalutaselskapene og brukerne i Nederland er ikke helt forn\u00f8yd med kunngj\u00f8ringen. Argumenter imot det<\/a> inkluderer at ikke engang nasjonalbankene er forpliktet til \u00e5 gj\u00f8re dette, og reguleringen var litt plutselig og den har ikke et solid hjemmel.<\/p>\n\n\n\n

Bitcoin gr\u00fcnder og personvern talsmann Matt Odell<\/a> uttalte at dette kan v\u00e6re den \u201cnaturlige utviklingen av KYC \/ AML<\/a> regs \u201d, og en \u201c\u00e5penbar forl\u00f8per for ordentlige selvforvaringsforbud\u201d over hele verden.<\/strong><\/p>\n\n\n\n

Dessverre b\u00f8r kryptovalutaselskapene som har som m\u00e5l \u00e5 lovlig operere i territoriet registreres hos myndighetene f\u00f8r 21. november 2020. Og til tross for at det er nytt, er disse tilleggstiltakene utenfor KYC et krav for registrering. S\u00e5 firmaene b\u00f8r tilpasse seg eller lukke.<\/p>\n\n\n\n

I mellomtiden noen bransjeakt\u00f8rer<\/a> l\u00f8fter stemmen mot denne bestemte avgj\u00f8relsen, eller pr\u00f8ver i det minste \u00e5 kj\u00f8pe mer tid til \u00e5 tilpasse systemene og kundene til den.<\/p>\n\n\n\n
