Dessverre slutter ikke dette vanskelige \u00e5ret veldig bra for Ripple Inc. og dets opprinnelige kryptovaluta, XRP. US Securities and Exchange Commission (SEC) avsl\u00f8rte nettopp en s\u00f8ksm\u00e5l mot selskapet for angivelig \u00e5 ha utf\u00f8rt et \u201c$1.3 milliarder uregistrert verdipapirtilbud\u201d<\/strong>, som de kaller de \u00f8konomiske aktivitetene med Ripple og XRP siden 2013.<\/p>\n\n\n\n

I f\u00f8lge pressemeldingen<\/a> av SEC, g\u00e5r s\u00f8ksm\u00e5let spesielt mot firmaet, men ogs\u00e5 Christian Larsen, selskapets medstifter, styreleder og tidligere administrerende direkt\u00f8r; og Bradley Garlinghouse, selskapets n\u00e5v\u00e6rende administrerende direkt\u00f8r. For dem, XRP er det vurdert<\/a> n\u00e5 et verdipapir, og selskapet samlet inn ikke-autoriserte midler fra amerikanske investorer.<\/p>\n\n\n\n

De hevder ogs\u00e5 at Larsen og Garlinghouse, \u201cUtf\u00f8rt personlig uregistrert salg av XRP p\u00e5 til sammen $600 millioner\u201d<\/strong>. Disse ville ogs\u00e5 ha juridiske konsekvenser<\/a> og ville bryte med Securities Act of 1993.<\/p>\n\n\n\n

Som svar, Garlinghouse publiserte et brev<\/a> forsvare selskapet og dets posisjon. Han hevder at andre amerikanske myndighetsgrener aldri ans\u00e5 Ripple og XRP som en sikkerhet, men som en valuta, inkludert justisdepartementet og finansdepartementets FinCen.<\/p>\n\n\n\n

Dette skaper en forferdelig bransjedrevet presedens for ethvert selskap som jobber med et digitalt aktivum [i landet]. "<\/p><\/blockquote>\n\n\n\n

Til tross for uttalelsen innr\u00f8mmet Garlinghouse ogs\u00e5 at dette plutselige angrepet f\u00f8rte dem til en "st\u00f8rre f\u00f8lelse av haster" for \u00e5 flytte hovedkontoret sitt utenfor forente stater<\/a>. Imidlertid er det fremdeles h\u00e5p, og noen eksperter og advokater mener at dette bare er en midlertidig snubling for Ripple og XRP.<\/p>\n\n\n\n
