Bitcoin og kryptovaluta er mer vanlig over hele verden hver dag. Som s\u00e5dan tar regulatorer fra overalt mer oppmerksomhet, spesielt til anti-hvitvaskingsregler (AML) -regler. Det er n\u00e5 tilfelle for Irland, hvis regulatorer har bestemt seg for \u00e5 ta med kryptoaktiva i deres neste AML-regelverk.<\/p>\n\n\n\n

I f\u00f8lge en nylig rapport<\/a> av lokale medier, virtuelle aktivateleverand\u00f8rer (VASPs) vil v\u00e6re p\u00e5lagt \u00e5 registrere seg i Irlands sentralbank <\/strong>starter i april 2021. Disse VASP-ene inkluderer krypto-sentraler, krypto-minibanker, depotleverand\u00f8rer og OTC-kontorer. I tillegg til den f\u00f8rste registreringen, vil det v\u00e6re obligatorisk for dem \u00e5 ordentlig identifisere kundene sine<\/a> (KYC). Tilsvarende opprinnelse og destinasjon for deres midler.<\/p>\n\n\n\n

Hvis kryptoselskapene ikke klarer \u00e5 gj\u00f8re det, har sentralbanken n\u00e5 makt "til \u00e5 blokkere senioravtaler i firmaene eller \u00e5 iverksette tiltak for manglende overholdelse av AML- eller CFT-lover". Tiltaket kommer ogs\u00e5 til \u00e5 oppfylle det siste EU-AML-direktivet. De samsvarende frist<\/a> for medlemsland (som Irland) er innen juni 2021.<\/p>\n\n\n\n

H\u00e5ndhevelsestiltakene for juridiske personer (dvs. selskaper) som bryter reglene inkluderer utelukkelse av offentlige fordeler (for eksempel finansiering), diskvalifisering fra ut\u00f8velse av kommersiell virksomhet og total nedleggelse av deres kontorer. Dessuten er minstestraffet for lovbryterne \u00f8kt til fire \u00e5r.<\/strong><\/p>\n\n\n\n

I tidligere \u00e5r utstedte Irlands sentralbank bare noen advarsler om kryptoer og innledende mynttilbud (ICO<\/a>). Imidlertid var kryptovalutaer uregulert i landet, og handlerne var for det meste anonyme. Det er i ferd med \u00e5 endre seg i \u00e5r.<\/p>\n\n\n\n

Advarsler utover krypto i Irland<\/strong><\/h2>\n\n\n\n

I en nylig rapport<\/a>, advarte European Securities and Markets Authority (ESMA) EU-investorer om ikke-regulerte kryptoaktiva. For dem er noen kryptoer "sv\u00e6rt risikable og spekulative." Imidlertid anerkjenner de ogs\u00e5 at Bitcoin og kryptoer blir mainstream<\/strong>, og det er spesiell bekymring om stallmynter<\/a>.<\/p>\n\n\n\n

Forrige m\u00e5ned, Den europeiske sentralbanken (ECB) erkl\u00e6rt<\/a> at de ville s\u00f8ke vetomakt over nye stablecoins. For enheten vil de aksepterte myntene innenfor deres jurisdiksjon ikke true kontrollen over inflasjon eller betalingssikkerheten. I tillegg vil stablecoin-utstedere v\u00e6re underlagt "strenge likviditetskrav".<\/strong><\/p>\n\n\n\n

Andre land, som Storbritannia<\/a> og forente stater<\/a>, utarbeider ogs\u00e5 nye forskrifter for stallmynter. Likevel virker det som gamle etablerte kryptoer som Bitcoin (BTC)<\/a> og Ethereum (ETH) er stort sett velkomne - med skikkelig KYC.
