De regelgeving voor het gebruik van cryptocurrencies wordt in Nederland steeds strenger. Onlangs heeft De Nederlandsche Bank (DNB) nieuwe wettelijke verplichtingen opgelegd aan de nationale cryptocurrency-bedrijven, die verder gaan dan het gebruikelijke Know Your Customer (KYC)-proces.<\/p>\n\n\n\n

Blijkbaar zal het nu niet voldoende zijn om documenten voor identificatie te verstrekken en\/of in sommige gevallen een oud en geverifieerd account te bezitten cryptocurrency-uitwisseling<\/a>. Het bedrijf dat bij de transactie betrokken is, moet controleren of "hun klanten en eventuele uiteindelijke begunstigden (UBO's) op een Nederlandse of Europese sanctielijst staan"<\/strong> en meld dit onmiddellijk aan de centrale instelling.<\/p>\n\n\n\n

Voor de gebruikers, deze verordening<\/a> impliceert extra controles zoals een verklaring van het doel van hun transactie, soort portemonnee en screenshots of ondertekeningsberichten. Als de klant op de sanctielijst staat, moeten de transactie en de rekening worden bevroren door de uitwisseling.<\/p>\n\n\n\n

Volgens de aankondiging<\/a>:<\/p>\n\n\n\n

\u201cBij een daadwerkelijke treffer op een sanctielijst moet de instelling DNB direct op de hoogte stellen, eventuele tegoeden bevriezen, de transactie blokkeren of beide. Dienovereenkomstig mogen activa niet worden vrijgegeven aan een andere, niet-gesanctioneerde partij. In specifieke gevallen moet ook de FIU-NL (Financial Intelligent Unit) worden aangemeld\u201d.<\/p><\/blockquote>\n\n\n\n

Als het bedrijf de treffer niet meldt, is zijn actie strafbaar op grond van de Wet economische delicten<\/a>. Dergelijke regelgeving beschrijft boetes tot 82.000 EUR (vijfde categorie) en zelfs zes jaar gevangenisstraf<\/strong>, afhankelijk van het financi\u00eble delict. Daarnaast kunnen aanvullende sancties de totale sluiting van het bedrijf, inbeslagname van de gelden en intrekking van overheidsuitkeringen zijn.<\/p>\n\n\n\n

Tegen de maatregel<\/strong><\/h2>\n\n\n\n

De cryptocurrency-bedrijven en gebruikers in Nederland zijn niet helemaal blij met de aankondiging. Argumenten tegen het<\/a> onder meer dat zelfs de nationale banken niet verplicht zijn dit te doen, en de verordening kwam nogal plotseling en heeft geen solide wettelijke basis.<\/p>\n\n\n\n

De Bitcoin-ondernemer en privacyadvocaat Matt Odell<\/a> verklaarde dat dit de \u201cnatuurlijke evolutie van KYC\/AML<\/a> regs\u201d, en een \u201cvoor de hand liggende voorloper van een echt verbod op zelfbewaring\u201d wereldwijd.<\/strong><\/p>\n\n\n\n

Helaas moeten de cryptocurrency-bedrijven die legaal op het grondgebied actief willen zijn, v\u00f3\u00f3r 21 november 2020 bij de autoriteiten worden geregistreerd. En, ondanks de nieuwigheid ervan, zijn die aanvullende maatregelen buiten KYC een vereiste voor de registratie. De bedrijven moeten zich dus aanpassen of sluiten.<\/p>\n\n\n\n

Ondertussen, sommigen actoren uit de industrie<\/a> verheffen hun stem tegen deze specifieke beslissing, of proberen in ieder geval meer tijd te winnen om hun systemen en klanten eraan aan te passen.<\/p>\n\n\n\n
