Helaas eindigt dit moeilijke jaar niet goed voor Ripple Inc. en zijn eigen cryptocurrency, XRP. De Amerikaanse Securities and Exchange Commission (SEC) heeft zojuist een rechtszaak tegen het bedrijf onthuld voor naar verluidt een \u201c$1,3 miljard niet-geregistreerde effectenaanbieding\u201d hebben uitgevoerd<\/strong>, zoals ze de financi\u00eble activiteiten met Ripple en XRP sinds 2013 noemen.<\/p>\n\n\n\n

Volgens het persbericht<\/a> door SEC, de juridische actie is specifiek gericht tegen het bedrijf, maar ook tegen Christian Larsen, de mede-oprichter van het bedrijf, uitvoerend voorzitter van de raad van bestuur en voormalig CEO; en Bradley Garlinghouse, de huidige CEO van het bedrijf. Voor hen, XRP wordt overwogen<\/a> nu een waardepapier, en het bedrijf haalde niet-geautoriseerde fondsen op bij Amerikaanse investeerders.<\/p>\n\n\n\n

Ze beweren ook dat Larsen en Garlinghouse, "heeft persoonlijke niet-geregistreerde verkopen van XRP uitgevoerd van in totaal ongeveer $600 miljoen"<\/strong>. Deze zouden ook hebben juridische gevolgen<\/a> en zou de Securities Act van 1993 schenden.<\/p>\n\n\n\n

Stephanie Avakian, directeur van de handhavingsafdeling van de SEC, zei hierover:<\/p>\n\n\n\n

\u201cWe beweren dat Ripple, Larsen en Garlinghouse hun voortdurende aanbod en verkoop van miljarden XRP aan particuliere beleggers niet hebben geregistreerd, waardoor potenti\u00eble kopers adequate openbaarmakingen over XRP en de activiteiten van Ripple en andere belangrijke langdurige beschermingen die fundamenteel zijn voor onze robuust systeem van de openbare markt.\u201d<\/p><\/blockquote>\n\n\n\n

Als direct gevolg van de aankondiging, XRP-prijs is in ongeveer twee dagen met bijna 40% gedaald<\/strong> en staat nog steeds in rode cijfers. Dit slechte nieuws komt erna een goede rally<\/a> in november, toen de valuta 137%+ verdiende.<\/p>\n\n\n\n

Een aanval op Ripple, XRP en crypto-industrie<\/strong><\/h2>\n\n\n\n

Als antwoord, Garlinghouse een brief gepubliceerd<\/a> het verdedigen van het bedrijf en zijn positie. Hij beweert dat andere Amerikaanse regeringsafdelingen Ripple en XRP nooit als een beveiliging maar als een valuta hebben beschouwd, waaronder het ministerie van Justitie en het FinCen van het ministerie van Financi\u00ebn.<\/p>\n\n\n\n

Bovendien verklaarde hij dat dit is niets meer dan een late aanval, niet alleen op Ripple en XRP, maar op de hele cryptowereld<\/strong> in het land.<\/p>\n\n\n\n

"We zullen agressief vechten - en onze zaak bewijzen - door deze zaak zullen we duidelijke regels krijgen voor de industrie hier in de VS (...) Laat me duidelijk zijn: Ripple, Chris, en ik kunnen degenen zijn die genoemd worden in de indienen, maar dit is een aanval op crypto in het algemeen. In dit geval is XRP een proxy voor elke andere 'alt-coin' in de ruimte. Van daaruit heb je een sneeuwbaleffect (...) Dit schept een verschrikkelijk precedent in de hele sector voor elk bedrijf dat met digitale activa werkt [in het land]."<\/p><\/blockquote>\n\n\n\n

Ondanks de verklaring gaf Garlinghouse ook toe dat deze plotselinge aanval hen een "groter gevoel van urgentie" gaf om hun hoofdkwartier buiten de Verenigde Staten<\/a>. Er is echter nog steeds hoop, en sommige experts en advocaten denken dat dit slechts een tijdelijk struikelblok is voor Ripple en XRP.<\/p>\n\n\n\n
