Bitcoin (BTC) en cryptocurrencies hebben in veel landen geen specifieke regelgeving. Ze zijn ook niet verboden, dus we zouden kunnen zeggen dat ze zich meestal in een juridisch limbo bevinden. Maar daar komt dit jaar snel verandering in. Veel landen besteden meer juridische aandacht aan deze activa. Wereldwijd zijn crypto-reguleringen aanstaande, en Turkije is geen uitzondering meer.<\/strong><\/p>\n\n\n\n

V\u00f3\u00f3r 2021 waren er geen specifieke crypto-regelgeving in Turkije. Desondanks blijkt uit een peiling van statistiek<\/a>, Turkije had 's werelds 4e hoogste gebruikspercentage voor cryptocurrency in 2020. Waarschijnlijk omdat zijn burgers hun geld wilden besparen van de sterk dalende nationale valuta en alarmerende inflatie.<\/p>\n\n\n\n

Samengevat: ze kunnen dit nog steeds. Het is volkomen veilig om te investeren in cryptocurrencies in dit land.<\/strong> Echter, de regering heeft verboden<\/a> de betalingen voor goederen en diensten met behulp van deze activa, sinds 30 april 2021. Strenge maatregelen tegen het witwassen van geld (AML) begonnen ook van toepassing te zijn op crypto-business, en er zijn meer regels in behandeling.<\/p>\n\n\n\n

Wijzigingen voor crypto-gebruikers<\/strong><\/h2>\n\n\n\n

De meest beruchte verandering voor individuele crypto-gebruikers in Turkije is natuurlijk het verbod op cryptobetalingen. Volgens Dagelijkse Sabah<\/a>, ongeveer 60 bedrijven geaccepteerd Bitcoin<\/a> en andere crypto's als betaalmethode in het land, alleen in 2019. Onder hen was Antalya Huizen<\/a>, een onroerend goed met de hoogste verkoop van dit type ooit in het land, in 2020 ($1,25 miljoen in BTC). Ze verkochten ook meerdere panden per jaar met crypto's.<\/p>\n\n\n\n

Helaas is dat voor nu voorbij. De nieuwe "Verordening over het niet-gebruik van crypto-activa bij betalingen" beschrijft<\/a> het volgende:<\/p>\n\n\n\n

"Bij de implementatie van deze verordening verwijst crypto-activa naar immateri\u00eble activa die virtueel zijn gecre\u00eberd met behulp van gedistribueerde grootboektechnologie of een vergelijkbare technologie (...) die niet direct of indirect worden gebruikt in betalingen (en) Er worden geen diensten geleverd waarbij het gebruik van van crypto-activa direct of indirect in betalingen.\u201d<\/p><\/blockquote>\n\n\n\n

Maar dit is niet alles voor crypto-regelgeving in Turkije. De nieuwe strikte AML-verplichtingen voor cryptobedrijven hebben ook gevolgen voor de gebruikers.<\/a> Als ze nu bijvoorbeeld een crypto-uitwisselings- of crypto-bewaarservice willen gebruiken, ze zullen zeer specifieke gegevens over zichzelf moeten verstrekken.<\/strong><\/p>\n\n\n\n

Het kan namen, geboorteplaats en -datum, nationaliteit, identiteitsdocumenten, beroep, contactmiddelen, handtekeningen en zelfs de namen van hun ouders bevatten. Hoe meer te verwerken in crypto's, hoe meer vereisten.<\/p>\n\n\n\n

Wijzigingen voor crypto-bedrijven<\/strong><\/h2>\n\n\n\n

De Turkse regering heeft besloten om crypto-bedrijven op te nemen in hun bestaande financi\u00eble wetten. Dus deze bedrijven moeten nu voldoen aan: de gewijzigde<\/a> Verordening inzake maatregelen ter voorkoming van witwasopbrengsten van misdrijven en financiering van terrorisme. Hieronder vallen alle traditionele maatregelen tegen witwassen (AML) en terrorismefinanciering (CFT).<\/p>\n\n\n\n

Trouwens, binnen de wet tegen crypto-betalingen,<\/a> de uitwisseling van cryptocurrencies via betalings-\/e-gelddiensten op cryptoplatforms is nu illegaal. Alleen contant geld en bankoverschrijvingen kunnen worden geaccepteerd in de handel<\/strong>. De crypto-bedrijven kunnen niet meer online samenwerken met deze financi\u00eble diensten.<\/p>\n\n\n\n

over de AML\/CFT-maatregelen<\/a>, noemden we al het identificatieproces voor gebruikers, waar elke crypto-onderneming aan moet voldoen. Bovendien moeten ze verdachte transacties melden aan de Turkse onderzoekscommissie voor financi\u00eble misdrijven (MASAK), ongeacht het bedrag. Maar ze moeten speciale aandacht besteden aan transacties van meer dan 75.000 Turkse lira (ongeveer $8.500) en deze ook rapporteren.<\/p>\n\n\n\n

De MASAK is ook bevoegd om crypto-bedrijven te auditen <\/strong>en vragen om gegevens zoals documenten en bescheiden. Voor dit doel moet de crypto-onderneming de informatie van klanten en AML ten minste acht jaar bewaren. De financi\u00eble sancties voor het niet naleven van een van deze regels vari\u00ebren tussen $3.500 en $466.000.<\/p>\n\n\n\n

Toekomst voor crypto-regelgeving in Turkije<\/strong><\/h2>\n\n\n\n

Onderwerpen zoals cryptocurrency-mijnbouw<\/a>, Eerste muntenaanbod (ICO's<\/a>), en crypto-gerelateerde belastingen worden niet genoemd in de huidige wetten. Dit betekent echter niet dat de overheid ze binnen afzienbare tijd niet kan opnemen. Inderdaad, volgens sommige rapporten<\/a>, is de regering van plan om in oktober 2021 nieuwe crypto-reguleringen in Turkije te presenteren.<\/p>\n\n\n\n

Onder de overwogen maatregelen<\/a> is de oprichting van een centrale bewaarbank om het tegenpartijrisico weg te nemen. Crypto-business zou minimale kapitaalvereisten hebben en ze zouden onder toezicht staan van de Capital Markets Board. Belastingen op het bezit van cryptocurrency liggen ook op tafel.<\/strong> En het bedrag voor gerapporteerde transacties kon<\/a> verminderen<\/a> tot amper 10.000 Turkse lira (ongeveer $1.200).<\/p>\n\n\n\n

Verder kunnen we er alleen maar naar gissen. Gezien het feit dat Turkije is een kandidaat-lidstaat<\/a> voor het lidmaatschap van de Europese Unie konden we de verordening over markten in crypto-activa zien (Mica<\/a>) op een gegeven moment ook in dit gebied. Deze wet zal vanaf 2022 of 2023 van toepassing zijn op alle lidstaten van de Europese Unie.<\/p>\n\n\n\n

Over crypto-regelgeving in de EU<\/h3>\n\n\n\n

Ze waren nog niet klaar met het voorstel, maar we kunnen enkele vereisten opnoemen die al een behoorlijke hoeveelheid zekerheid hebben. Om te beginnen zouden de bedrijven hun hoofdkantoor in de Europese Unie moeten hebben. Ze hebben ook een minimaal kapitaalbedrag nodig (meestal meer dan $350.000 of 2% van het gemiddelde bedrag aan reserveactiva), een volledig beveiligd digitaal platform, een bekwaam team en als ze tokenuitgevers zijn, een zeer gedetailleerde whitepaper.<\/p>\n\n\n\n

Diensten zoals bewaring of uitwisselingen moeten voldoen aan AML- en CFT-maatregelen<\/strong>, en verstrekken altijd transparante en waarheidsgetrouwe informatie aan hun klanten. Alle cryptobedrijven hebben een vergunning nodig om binnen (of voor de burgers van) de Europese Unie te opereren. Het is geen groot verschil met de stroom crypto-voorschriften<\/a> in Turkije wel.<\/p>\n\n\n\n

Voor nu is het belangrijk om te voldoen aan de huidige regels en te controleren op meer nieuws hierover.<\/p>\n\n\n\n
