Os regulamentos para o uso de criptomoedas est\u00e3o se tornando mais r\u00edgidos na Holanda. Recentemente, seu Banco Central Holand\u00eas (DNB) entregou novas obriga\u00e7\u00f5es legais para as empresas nacionais de criptomoedas, que v\u00e3o al\u00e9m do processo comum de Conhe\u00e7a seu Cliente (KYC).<\/p>\n\n\n\n

Aparentemente, agora n\u00e3o ser\u00e1 suficiente fornecer documentos de identifica\u00e7\u00e3o e \/ ou possuir uma conta antiga e verificada em algum troca de criptomoeda<\/a>. A empresa envolvida na transa\u00e7\u00e3o deve verificar se "seus clientes e quaisquer propriet\u00e1rios benefici\u00e1rios finais (UBOs) est\u00e3o em uma lista de san\u00e7\u00f5es holandesa ou europeia"<\/strong> e imediatamente relatar \u00e0 institui\u00e7\u00e3o central.<\/p>\n\n\n\n

Para os usu\u00e1rios, este regulamento<\/a> implica verifica\u00e7\u00f5es adicionais, como uma declara\u00e7\u00e3o da finalidade da transa\u00e7\u00e3o, tipo de carteira e capturas de tela ou mensagens de assinatura. Caso o cliente esteja na lista de san\u00e7\u00f5es, a transa\u00e7\u00e3o e a conta devem ser congeladas pela bolsa.<\/p>\n\n\n\n

De acordo com o an\u00fancio<\/a>:<\/p>\n\n\n\n

\u201cEm caso de acerto efetivo em lista de san\u00e7\u00f5es, a institui\u00e7\u00e3o deve notificar imediatamente o DNB, bem como congelar quaisquer ativos, bloquear a transa\u00e7\u00e3o ou ambos. Consequentemente, os ativos n\u00e3o podem ser liberados para qualquer outra parte n\u00e3o sancionada. A FIU-NL (Unidade de Intelig\u00eancia Financeira) tamb\u00e9m deve ser notificada em casos espec\u00edficos \u201d.<\/p><\/blockquote>\n\n\n\n

Se a empresa n\u00e3o relatar o acerto, sua a\u00e7\u00e3o ser\u00e1 pun\u00edvel nos termos do Lei de Ofensas Econ\u00f4micas<\/a>. Tal regulamento descreve multas de at\u00e9 82.000 EUR (quinta categoria) e at\u00e9 seis anos de pris\u00e3o<\/strong>, dependendo da infra\u00e7\u00e3o financeira. Al\u00e9m disso, as san\u00e7\u00f5es adicionais podem ser o fechamento total da empresa, a apreens\u00e3o dos fundos e a retirada de benef\u00edcios governamentais.<\/p>\n\n\n\n

Contra a medida<\/strong><\/h2>\n\n\n\n

As empresas de criptomoedas e usu\u00e1rios na Holanda n\u00e3o est\u00e3o muito felizes com o an\u00fancio. Argumentos contra isso<\/a> inclusive que nem os bancos nacionais s\u00e3o obrigados a fazer isso, e a regula\u00e7\u00e3o foi meio repentina e n\u00e3o tem base legal s\u00f3lida.<\/p>\n\n\n\n

O empres\u00e1rio Bitcoin e defensor da privacidade Matt Odell<\/a> afirmou que esta pode ser a "evolu\u00e7\u00e3o natural de KYC \/ AML<\/a> regs \u201d, e um \u201cprecursor \u00f3bvio para proibi\u00e7\u00f5es adequadas de autocuidado\u201d em todo o mundo.<\/strong><\/p>\n\n\n\n

Infelizmente, as empresas de criptomoeda que pretendem operar legalmente no territ\u00f3rio devem ser registradas junto \u00e0s autoridades antes de 21 de novembro de 2020. E, apesar de sua novidade, essas medidas adicionais al\u00e9m do KYC s\u00e3o um requisito para o registro. Portanto, as empresas devem se adaptar ou fechar.<\/p>\n\n\n\n
