Regler f\u00f6r anv\u00e4ndning av kryptovalutor blir str\u00e4ngare i Nederl\u00e4nderna. Nyligen levererade dess nederl\u00e4ndska centralbank (DNB) nya juridiska skyldigheter f\u00f6r de nationella kryptovalutaf\u00f6retagen, som g\u00e5r l\u00e4ngre \u00e4n den gemensamma KYC-processen (Know Your Customer).<\/p>\n\n\n\n

Tydligen r\u00e4cker det inte nu att tillhandah\u00e5lla dokument f\u00f6r identifiering och \/ eller \u00e4ga ett gammalt och verifierat konto i vissa utbyte av kryptovaluta<\/a>. F\u00f6retaget som \u00e4r inblandat i transaktionen b\u00f6r kontrollera om "deras kunder och eventuella ultimata mottagare (UBO: er) finns p\u00e5 en nederl\u00e4ndsk eller europeisk sanktionslista"<\/strong> och omedelbart rapportera det till den centrala institutionen.<\/p>\n\n\n\n

F\u00f6r anv\u00e4ndarna, denna f\u00f6rordning<\/a> inneb\u00e4r ytterligare kontroller som en deklaration av syftet med deras transaktion, typ av pl\u00e5nbok och sk\u00e4rmdumpar eller signeringsmeddelanden. Om kunden finns p\u00e5 sanktionslistan b\u00f6r transaktionen och kontot frysas av b\u00f6rsen.<\/p>\n\n\n\n

Enligt tillk\u00e4nnagivandet<\/a>:<\/p>\n\n\n\n

\u201dI h\u00e4ndelse av en verklig tr\u00e4ff i en sanktionslista m\u00e5ste institutionen omedelbart meddela DNB, samt frysa alla tillg\u00e5ngar, blockera transaktionen eller g\u00f6ra b\u00e5da. F\u00f6ljaktligen f\u00e5r tillg\u00e5ngar inte frig\u00f6ras till n\u00e5gon annan, icke-sanktionerad, part. FIU-NL (Financial Intelligent Unit) m\u00e5ste ocks\u00e5 meddelas i specifika fall \u201d.<\/p><\/blockquote>\n\n\n\n

Om f\u00f6retaget misslyckas med att rapportera tr\u00e4ffen skulle dess handlingar vara straffbara enligt Lagen om ekonomiska brott<\/a>. En s\u00e5dan reglering beskriver b\u00f6ter upp till 82 000 EUR (femte kategorin) och till och med sex \u00e5rs f\u00e4ngelse<\/strong>, beroende p\u00e5 den ekonomiska \u00f6vertr\u00e4delsen. Dessutom kan ytterligare sanktioner vara den totala nedl\u00e4ggningen av f\u00f6retaget, beslag av medlen och \u00e5terkallande av statliga f\u00f6rm\u00e5ner.<\/p>\n\n\n\n
